State Reporting Deadlines and Information for Chapters

(Jan. 6, 2003) - A number of states require solicitation disclosure statements on all written materials mailed to potential donors in their states. The following lists the states and the most recent disclosure information to be included on all charitable solicitations mailed to residents in these states.

Also at the bottom of this outline is a 'Model Paragraph' which encompasses all the required disclosures and can be customized for your organization.

The Disclosures that appear in quotes are statutorily required to be transcribed verbatim. Those that do not appear in quotes may be modified according to your needs, however, they must contain the basic information provided below.

Florida

The following verbatim disclosure must be conspicuously displayed, IN CAPITAL LETTERS, and included on all fundraising materials sent to Florida residents:

'A COPY OF THE OFFICIAL REGISTRATION AND FINANCIAL INFORMATION MAY BE OBTAINED FROM THE DIVISION OF CONSUMER SERVICES BY CALLING TOLL-FREE, WITHIN THE STATE, 1-800-HELP-FLA. REGISTRATION DOES NOT IMPLY ENDORSEMENT, APPROVAL, OR RECOMMENDATION BY THE STATE.'

The disclosure statement must also include your registration number.

The statute states that when the solicitation consists of more than one piece, "the statement must be displayed prominently" in the materials.

Maryland

Solicitations must state that:

For the cost of postage and copying, documents and information filed under the Maryland charitable organizations laws can be obtained from the Secretary of State, Charitable Division, State House, Annapolis, MD 21401.

According to the statute, the statement must be conspicuously displayed on any written or printed solicitation and, 'If there is more than one piece in the solicitation package, the statement must be displayed on a prominent part of the solicitation materials."

Michigan

No disclosure statement required. However, the state Attorney General's office strongly encourages inclusion of the organization's Michigan registration number in all solicitations written as: 'MICS No._____.'

Mississippi

The following statement must be reproduced verbatim on written solicitations, confirmations, receipts and reminders of oral solicitations:

"The official registration and financial information of [insert the legal name of the charity as registered with the Secretary of State] may be obtained from the Mississippi Secretary of State's office by calling 1-888-236-6167. Registration by the Secretary of State does not imply endorsement."

New Jersey 

The following disclosure must be "conspicuously printed" on any printed solicitation, written confirmation receipt or written reminder of a contribution from an organization, independent paid fund raiser or solicitor:

Information filed with the Attorney General concerning this charitable solicitation may be obtained from the Attorney General of the State of New Jersey by calling 1-973-504-6215. Registration with the Attorney General does not imply endorsement.

New York 

Solicitations must state that:

A copy of the latest annual report can be obtained from the organization or from the Office of the Attorney General by writing the Charities Bureau, 120 Broadway, New York, NY 10271.

The disclosure must be placed conspicuously in the materials with print no smaller than 10 point bold face type or, alternatively, no smaller than the size print used for the most number of words in the solicitation.

North Carolina

Every charitable organization or sponsor that is required to obtain a license shall conspicuously display the following statement on every printed solicitation, written confirmation, receipt or reminder of a contribution:

Financial information about this organization and a copy of its license are available from the State Solicitation Licensing Branch at 1-888-830-4989. The license is not an endorsement by the state.

The statement printed in nine-point type should be made conspicuous by one of the following: a border, underlining, or bold type.

In addition professional solicitors will be required to make the following disclosure to any oral or written solicitation, confirmation, receipt or reminder:

Financial information about the solicitor and a copy of its license are available from the state Solicitation and Licensing Branch at 1-888-830-4989. The license is not an endorsement by the state.

Pennsylvania

The following must be reproduced verbatim and "conspicuously printed":

'The official registration and financial information of [organization] may be obtained from the Pennsylvania Department of State by calling toll-free, within Pennsylvania, 1-800-732-0999. Registration does not imply endorsement.'

Virginia

Although required by law only of Professional Solicitors, the Office of Consumer Affairs is requesting all nonprofits to include a disclosure stating that:

Financial statements are available from the State Division of Consumer Affairs, P.O. Box 1163, Richmond, VA 23218.

Washington

Solicitation must state if charity is registered with the Secretary of State:

Information relating to the financial affairs of [organization] is available from the Secretary of State, and the toll-free number for Washington residents: 1-800-332-4483.

West Virginia 

The following statement is required:

West Virginia residents may obtain a summary of the registration and financial documents from the Secretary of State, State Capitol, Charleston, WV 25305. Registration does not imply endorsement.

There are no placement requirements for this disclosure.

Financial information about [organization] can be obtained by writing to us at [organization's address] or as stated below: Florida: SC No. A COPY OF THE OFFICIAL REGISTRATION AND FINANCIAL INFORMATION MAY BE OBTAINED FROM THE DIVISION OF CONSUMER SERVICES BY CALLING TOLL-FREE, WITHIN THE STATE, 1-800-HELP-FLA.
